Welcome to PHOTO MEMORY BRACELET® (“we,” “us,” or “our”). By accessing our website or placing an order, you agree to these Terms of Service (“Terms”). If you do not agree, please do not use our website or services.

1. Eligibility & Use of Website

• You must be at least 18 years old or have permission from a parent or legal guardian to use this website.
• You agree to use this site only for lawful purposes and in compliance with these Terms.
• We reserve the right to refuse service to anyone for any reason at any time.

2. Products & Custom Orders

• All products are custom-made and personalized based on information provided by the customer.
• Production begins shortly after an order is placed and cannot be stopped once started.
• Colors, materials, and details may vary slightly due to screen settings and manufacturing processes.
• You are responsible for ensuring all personalization details (including photos and text) are correct before submitting your order.
• We are not responsible for errors caused by incorrect personalization details provided by the customer.

3. Orders & Payment

• Placing an order constitutes an offer to purchase.
• Orders are not accepted until payment is successfully processed.
• Once production has begun, orders cannot be canceled or changed.
• We reserve the right to cancel or refuse orders suspected of fraud or unauthorized activity.
• Prices are subject to change without notice and are confirmed at checkout.

4. Shipping & Delivery

• All orders ship from our production partner in China.
• Production time is approximately 3–5 business days.
• Estimated delivery time after shipment is 7–14 business days.
• Delivery times are estimates only and are not guaranteed.
• We are not responsible for delays caused by shipping carriers, customs, or events outside our control.
• Risk of loss passes to you once the order is handed to the carrier.

5. Duties, Taxes & Fees

• International orders may be subject to import duties, VAT, customs fees, or taxes.
• These charges are not included in product prices and are the customer’s responsibility.
• We are not responsible for customs delays or fees.

6. Returns, Refunds & Replacements

Our return and refund practices are governed by our Return & Refund Policy, which is incorporated into these Terms by reference.

• Custom and personalized items are non-returnable for buyer’s remorse, change of mind, or incorrect personalization provided by the customer.
• Defective, damaged, or incorrect items caused by our error must be reported within 30 days of delivery.
• Eligible cases will receive either a free replacement or a refund to the original payment method.
• If a replacement is not acceptable or available, a refund will be issued.
• Shipping costs and import duties are non-refundable.

7. Lost, Stolen, or Damaged Packages

• Lost packages with no tracking movement for 10 or more consecutive days may be reshipped after carrier confirmation.
• Packages marked “Delivered” but not received should first be checked with neighbors, mailbox areas, or building management.
• A one-time courtesy replacement may be offered for confirmed stolen packages.
• Damaged items must be reported within 30 days of delivery.

8. User-Submitted Content

• You confirm that any photos or content you upload are owned by you or that you have the legal right to use them.
• You grant us a limited license to use submitted content solely to produce your custom product.
• Uploaded content must not violate copyright, trademark, privacy, or other rights.

9. Intellectual Property

• All website content, including text, images, logos, designs, and product descriptions, is the property of Photo Memory Bracelet® or its licensors.
• You may not copy, reproduce, distribute, or exploit any content without prior written permission.

10. Prohibited Uses

• Illegal or fraudulent activities
• Violating intellectual property or privacy rights
• Uploading harmful, abusive, or inappropriate content
• Attempting to interfere with site security or functionality

11. Disclaimer of Warranties

All products and services are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free website operation. To the fullest extent permitted by law, all implied warranties are disclaimed.

12. Limitation of Liability

To the fullest extent permitted by law, Photo Memory Bracelet® shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid for the product.

13. Indemnification

You agree to indemnify and hold harmless Photo Memory Bracelet® from any claims, damages, or expenses arising from your breach of these Terms or misuse of our services.
